In der Scharīʿa bedeutet Taqlīd: „Die Aussage eines anderen ohne Beweis zu akzeptieren." (Imam Ghazali, Al-Mustasfa, Bd. 2, S. 387) Das arabische Wort für Beweis ist hier „Hujjah" und der Text des Qurʾans ist selbst eine Hujjah und so ist es auch die Sunnah des geliebten Gesandten Allahs sallallahu 'alayhi wa sallam. Aus diesem Grund können wir keinen Taqlid bei Allah subhanahu wa ta'ala oder dem Gesandten Allahs sallallahu 'alayhi wa sallam machen, denn der Qurʾan und die Sunnah sind selbst beide Hujjah. Um Taqlid auszuüben, muss man die Aussage eines anderen akzeptieren, ohne den Beweis (Hujjah) zu verlangen und dies ist nur möglich, wenn solch eine Aussage nicht im direkten Kontext des Qurʾans oder der Sunnah steht. Das heißt, man kann nicht Taqlid bei Qurʾan und der Sunnah ausüben. Wenn man mir befehlen würde, eine bestimmte Handlung zu tun oder etwas zu unterlassen, was nicht direkt im noblen Qurʾan oder der Sunnah gefunden werden kann oder es kann gefunden werden, aber der Hinweis wäre vage und unverständlich für eine Person meines Unvermögens, so wäre mein Gehorsam solch einer Anweisung einer qualifizierten Person gegenüber die Ausübung des Taqlid. Obgleich es Meinungsunterschiede unter den Rechtsgelehrten bezüglich des Verständnisses verschiedener Texte gibt, muss der Folger dem folgen, bei dem er sich am sorglosesten fühlt (seiner madhhab), was das Praktizieren des Islam angeht. Der Folger sollte darauf versuchen, alle Entscheidungen, welche dieser Imam aus den Quellen abgeleitet hat, zu befolgen, unabhängig davon, ob sie leicht oder schwer sind. Dies wäre die wahre Essenz des Taqlīd. Der Folger sollte alle Entscheidungen dieses bestimmten Imams zu jeder Zeit als endgültig akzeptieren.
